NDA Submission to the Department of Health to inform its consultation on the development of Protection of Liberty Safeguards legislation

The NDA inputted into the Department of Health’s consultation on Protection of Liberty Safeguards. The NDA is represented on the Expert Advisory Group to support the development of policy and legislation in this area. Our submission highlighted overarching considerations connected to the draft legislation, including the need to consider meaningful alternatives to detention, the provision of advocacy services to those subject to a possible deprivation of liberty and alignment with the Optional Protocol to the Convention against Torture. We also raised considerations relevant to the Regulatory Impact Assessment for this legislation, including supports to assist with transitional arrangements.
